Terms of Use

Effective date: 23 October 2026. These Terms replace the version dated 1 August 2022.

These Terms of Use are an agreement between you and Pi-A Creative Systems Ltd ("Pi-A", "we", "us"), company number 12832544, registered in England and Wales and based in London, United Kingdom, about your use of the Lungy app and the lungy.app website ("Lungy"). Please read them with our Privacy Policy and our Medical Disclaimer. By using Lungy you agree to them. If you do not agree, please do not use Lungy.

1. What Lungy is

Lungy is a breathing exercise app. It uses your phone's microphone, and optionally its camera, to recognise your breathing and respond to it with visuals and sound. It is designed to make breathing exercises engaging for relaxation, sleep, focus and sport. Lungy is not a medical device and does not diagnose, treat or monitor any condition. Our Medical Disclaimer explains this fully and you should read it before you start.

2. Who can use Lungy

You must be 16 or over, or have a parent or guardian's permission if you are younger and your local law allows it. By using Lungy you confirm that you are able to enter into this agreement.

3. No accounts

Lungy does not have user accounts. You do not register, and we do not ask for your name or email address to use the app. Your results and progress are stored on your device, so if you delete the app or change phones they may be lost unless you have backed up your device. Purchases are tied to your Apple ID and can be restored from the app.

4. Subscriptions and purchases

Some features need a paid subscription or a one-off lifetime purchase. All payments are made through the Apple App Store under Apple's terms. The price, the renewal period, any free trial and what is included are shown in the app before you buy.

  • Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel at any time in your Apple ID settings, and you keep access until the end of the period you have paid for.
  • If a free trial is offered, your subscription starts and you are charged when the trial ends unless you cancel before then. Any unused part of a trial is forfeited when you buy a subscription.
  • A lifetime purchase gives access to the paid features for as long as we offer Lungy on the App Store. It is linked to your Apple ID and cannot be transferred or exchanged.
  • Refunds are handled by Apple under its refund policy, and nothing in these Terms limits your statutory rights as a consumer, including any right to cancel within 14 days where that applies.
  • We may change prices or plans for the future. Changes to an existing subscription take effect only at the next renewal, after notice, and you can cancel before then.

5. Using Lungy safely and fairly

You agree to use Lungy only as intended and not to:

  • use it while driving, swimming, bathing or doing anything where losing focus could hurt you or others;
  • copy, modify, reverse engineer, resell or redistribute the app or its content, or try to get around its purchase controls;
  • interfere with the app's operation or security, or use automated tools against it or the website;
  • use Lungy in a way that breaks the law or infringes anyone's rights.

If you share a phone, remember that your breathing results on the device are visible to anyone who uses it.

6. Your health

Lungy is intended for general wellbeing. It is not a substitute for medical advice, diagnosis or treatment, and must never be used instead of medication or emergency care. If you have a medical condition, are pregnant or are unsure whether breathing exercises are right for you, speak to a doctor first. Stop and seek advice if you feel unwell while using it. The Medical Disclaimer forms part of these Terms.

7. Your licence to use Lungy

We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Lungy app on Apple devices you own or control, under these Terms and the App Store rules. Lungy's software, visuals, animations, sounds, text, trademarks and the Lungy name belong to Pi-A or its licensors and are protected by law. Lungy generates unique visuals and audio during each session; you may share recordings of your own sessions on your personal social media with a credit to Lungy, but not for commercial purposes without our written consent. 8. Availability and changes

We work to keep Lungy running, but we cannot promise it will always be available or free of errors, and we may change, suspend or withdraw features, or the app itself, with reasonable notice where we can. Some features depend on your device's hardware, such as a TrueDepth camera, or on the operating system version. If we withdraw a paid feature you have paid for in advance, you may be entitled to a proportionate refund through Apple.

9. Our responsibility to you

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, and our total liability is limited to the amount you have paid for Lungy in the 12 months before the claim. We are not responsible for loss that was not foreseeable, for business losses, or for problems caused by your device, your network or your failure to follow the Medical Disclaimer.

10. Ending this agreement

You can stop using Lungy at any time by deleting the app; cancel any subscription in your Apple ID settings first. We may suspend or end your access if you seriously or repeatedly break these Terms. If we do, you can write to hello@lungy.app to appeal.

11. Transfer of this agreement

We may transfer our rights and obligations under these Terms to another organisation, for example if Lungy is sold or Pi-A is reorganised. We will tell you if this happens and it will not reduce your rights. You may not transfer your rights under these Terms to anyone else.

12. Other terms

  • These Terms, the Privacy Policy and the Medical Disclaimer are the whole agreement between us about Lungy. Apple is not a party to it, but Apple and its subsidiaries may enforce it against you as a third-party beneficiary, as the App Store requires.
  • If any part of these Terms is found to be invalid, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • We may update these Terms. If a change affects your rights, we will tell you in the app before it takes effect; continuing to use Lungy after that means you accept the new Terms.

13. Complaints, law and courts

If something has gone wrong, please email hello@lungy.app and we will try to put it right within 30 days. These Terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales. If you live in Scotland, Northern Ireland or an EU country, you may also bring a claim in your local courts, and you keep the protection of the consumer laws that apply where you live. Nothing in these Terms takes away your right to go to court.
